Prosecutor recants the indefinite postponement of the Psycharis case

The judicial adventures continue for the head of the Lambrakis Media Group (DOL) Stavros Psycharis, for the offense of infringement of the Law on his Asset Means Declaration statements.

The prosecutor of the Supreme Court, Xeni Demetriou, appealed against the decision of the I’ Three-Member Misdemeanor Court of Athens, which annulled the summons to the head of DOL Stavros Psycharis, upon objection of his lawyers. The cancellation was decided, as it was deemed that the indictment did not specify whether the Psycharis had committed the offense of infringement of the law on Asset Means Decleration, intentionally or by negligence.

That said, the case returned to the Athens First Instance Court Prosecution Office in order to pinpoint the subjective reality of the acts attributed to the head of the DOL.

Yesterday however, the prosecutor of the Supreme Court Xeni Demetriou, appealed against the ruling of the I’ Three-Member Misdemeanor Court of Athens, arguing that the court misapplied the relevant provisions of the Criminal Code and Law 3213/2003 on the submission of Asset Means Declaration statements, and as such incorrectly canceled the summons which had been served legitimately to the head of the publishing group.

At the same time, the Supreme Court prosecutor argues that the criminal law does not have to explicitly indicate that the act was committed intentionally, because when the form of fault in relation to the offense is not mentioned, it is clear that there is a case of malice or intent.

Finally, the appeal of Mrs Demetriou will be introduced to the Criminal Division of the Supreme Court for judgment.
